'The DA caused all this to happen' attorney for troopers says of altered police report

WORCESTER, Mass. -- No one will be charged regarding the state police scandal involving the changing of an arrest report belonging to a judge's daughter.

The lawyer for the state trooper who made the arrest said that’s just wrong, and he believes Worcester County District Attorney should be held accountable.

“The District Attorney caused all this to happen and it’s a shame to me that Col. McKeon and his reputation is in tatters,” attorney Leonard Kesten said.

According to a state report issued by the new Massachusetts State Police Colonel, Former Col. Rick McKeon showed "flawed judgment and the lack of a professional analysis" when he forced a trooper to revise Bibaud’s arrest report from Oct. 16, 2017.

The state police report confirms Worcester Country District Attorney Joseph Early called then-Col. McKeon on Oct. 17 and asked if he had seen the report. It also notes Early provided McKeon with the name of the Trooper who had filed it.

Kesten represents Trooper Ryan Sceviour, who made the arrest. Kesten says it wasn’t just “flawed judgement” that caused a wave of early retirements and embroiled state police in the scandal over heroin, sex, and a judge’s daughter. In fact, it was the direction of District Attorney Joseph Early.

“The evidence is crystal clear, the report was prepared, it was submitted to court, nobody was going to look at it, they were done. District Attorney Early called Col. McKeon, asked him to change the report, the colonel resisted, the district attorney persisted, and they ruined their careers,” Kesten said.

The state police report rips McKeon for taking advice from Early, who told him to remove lewd statements Bibaud made when she was arrested.

But Kesten says the report also shows that McKeon initially resisted, and it was only when Early pushed him that he acted, and this line from the state police report proves it - “Early asked McKeon, ‘What are you going to do’ about the Bibaud report. McKeon said he could not do anything because he ‘thought that ship had sailed…’”

Kesten says not only was this improper, it was illegal, and DA Early should be out of the job along with Col. McKeon.

“The district attorney is elected, it’s up to the voters. But the district attorney caused all this to happen,” he said.

Early is up for reelection this year, and the man running against him is urging voters to make a change. He tweeted Friday that the report clearly refers early to the ethics commission for wrongdoing.

A spokesman for the Worcester County DA says the DA's Office acted lawfully in this matter. The Attorney General says she's referred this to the Massachusetts Ethics commission as she says there's no evidence of criminal wrongdoing.
