The Springfield News-Sun reports a Champaign County judge on Wednesday made the ruling after hearing arguments on defense motions in Ely Serna's case. Serna has pleaded not guilty by reason of insanity to charges including attempted murder in last year's shooting at West Liberty-Salem High School in West Liberty.
Serna's attorney argued the case should go back to juvenile court for a hearing on Serna's likelihood of rehabilitation in the juvenile system. A message seeking comment has been left for Serna's attorney.
Authorities allege the 17-year-old Serna fired a shotgun at a classmate, critically wounding him and slightly injuring another student.
No motive has been disclosed.
