Tsarnaev's attorneys are asking that the trial be moved out of Massachusetts because survey data they obtained last month shows that there is an overwhelming presumption of guilt in the Commonwealth, prejudgement of the penalty that should be imposed and an overwhelming amount of people in the potential jury pool attended, participated in, or know someone who participated in the 2013 Boston Marathon.
The defense experts surveyed people in four areas including Boston, Springfield, Manhattan and Washington DC.
Washington DC had the lowest levels of presumption of guilt and lowest percentage of people who took part in or know someone who took part in the marathon last year. The defense recommended the District of Columbia for those reasons. However, they say they still need more time to study the issue before the trial, which is scheduled to start in November.
Tsarnaev and his brother planted two pressure cooker bombs close to the finish line of the 2013 Boston Marathon. The bombs killed three people and injured more than 260 others. Tsarnaev pleaded not guilty to federal charges and may face the death penalty. His brother died after a shootout with police in Watertown.
