Prosecutor: Man charged with 9th OUI already had license permanently revoked

BOSTON — A Dorchester man has been ordered to remain in jail after facing his ninth OUI charge in court Monday.

Police say when they pulled him over, his 10-year-old son was in the back seat and the car was littered with mini liquor bottles.

The judge ordered Victor Rosa to be kept in jail after prosecutors questioned his long history of drunk driving.

Police say they stopped Rosa's car on Route 2 after he was weaving between lanes and nearly struck an officer's cruiser.

“He did fail field sobriety tests, he also submitted to a breath test, which yielded a 0.18 reading,” assistant prosecutor Jacob McCrindle said.

Police say Rosa's car was littered with empty Heineken cans and bottles, and alcohol nips. In the backseat, they found Rosa’s 10-year-old son asleep without a seatbelt on.

Prosecutors say Rosa should never have gotten behind the wheel in the first place.

“A review of his board of probation shows a lengthy history of prior convictions for OUI,” McCrindle said.

A review of court records shows Rosa has eight previous convictions for OUI, stretching back three decades.

“I know what the prosecutor said in court, but they haven't given me any documentation yet so I have to wait and see what they give me,” defense attorney Joanne Daley said.

Rosa's attorney told us her client is a disabled veteran and he needs help not more jail time.

“We'll obviously get into that more in court on Friday and hopefully get him some services,” said Daley.

Police say DCF is now involved with Rosa and his son.
