Mass. gets warrant for Tsarnaev in Collier's death

BOSTON (MyFoxBoston.com) -- The Middlesex District Attorney's Office has been granted a default warrant for Dzhokhar Tsarnaev in connection with the death of MIT Police Officer Sean Collier.

Tsarnaev, 20, was indicted by a Middlesex Grand Jury on charges of murder, attempted armed robber, four counts of armed assault with intent to murder, four counts of assault with a dangerous weapon, kidnapping, armed robbery, unlawful possession of a firearm, possession of a large capacity feeding device and possession of a firearm with a defaced serial number.

The Middlesex County DA's office said they plan to prosecute Tsarnaev in Collier's death and for his alleged involvement in a shootout with police in Watertown, Mass.

Tsarnaev, who is in federal custody, can't be arraigned on the Mass. charges until he is physically present.  The U.S. Marshals Service said Tsarnaev wouldn't be available for arraignment.

"Mr. Tsarnaev will not be made available for arraignment in the state case at this time," read a statement released by the U.S. Marshals Service and U.S. Attorney's Office. "We expect that the defendant will be made available once the federal proceedings have concluded."

The default warrant assures his appearance in Middlesex Superior Court following his federal trial.

Tsarnaev is charged in a 30-count federal indictment, including 17 charges that carry the possibility of the death penalty in connection with the Boston Marathon bombings. He has pleaded not guilty.
