Judge denies gag order in Hernandez double murder case

FALL RIVER, Mass. (MyFoxBoston.com) – A judge denied a gag order without prejudice that was requested by Aaron Hernandez in the Boston double murder case, meaning it can be revisited.

In the former Patriot’s motion, he cites a ruling by a superior court judge in another county in the Odin Lloyd murder case, “where his motion for such an order was ultimately allowed,” according to court documents.

The document goes on to say that Hernandez did not point out that the same judge initially denied his motion.

“Judge Garsh allowed the defendant’s renewed motion only after there were alleged prejudicial extrajudicial statements and information released and where the prosecution in Bristol County agree to portions of the proposed order,” the document read.

The motion did not provide facts or support of any allegation that the state has violated the Rules of Professional Conduct by making prohibited extrajudicial statement, according to the document. Therefore, the gag order was denied.

Hernandez is accused of killing Safiro Furtado and Daniel Abreu in Boston's South End in July of 2012. He has pleaded not guilty in that case, as well as the Odlin Lloyd murder case.

And in another filing Tuesday, a search warrant was issued to Apple Inc. in California for information from Hernandez's fiance's Apple devices.

The warrant is seeking various data from Shayanna Jenkins' iPhone, two iPads, and her i-cloud account. Specifically, officials are looking for GPS information, email, texts, call logs, and data from apps or websites related to a home surveillance system. They're also looking for any information deleted from any of the devices. Jenkins is charged with perjury in connection to the Lloyd murder case.
