Judge calls for prison chief to swear to progress in search for Kosilek's surgeon

BOSTON (FOX 25 / MyFoxBoston.com) The federal judge who ruled that the state must pay for a convicted murderer's sex reassignment surgery has reportedly ordered the state's prison chief to swear he is doing everything he can to find a surgeon for the operation.

According to the Boston Globe, Judge Mark Wolf filed an order calling for Correction Commissioner Luis S. Spencer to sign status reports while under oath that describe his search for a doctor. The newspaper also reports that Judge Wolf is calling for Spencer to swear he has personally read Wolf's order while under oath.

In Sept. 2012, Judge Wolf ruled that the surgery is the only adequate treatment for Michelle Kosilek's gender-identity disorder. The surgery has been put on hold after the state appealed Wolf's decision. However, Wolf ordered the Department of Correction to prepare for the surgery in the event that the legal dispute comes to an end.

Kosilek was named Robert when convicted of killing his wife, Cheryl, in 1990.
