Hearing over DA's summary of Remy case canceled

WOBURN, Mass. (AP) - A hearing scheduled for the son of a Red Sox broadcaster charged with fatally stabbing his girlfriend was canceled Tuesday.

Jared Remy's lawyers planned to ask a Massachusetts judge to stop prosecutors from releasing a written summary of their case.

Remy is charged with murder in the Aug. 15 stabbing death of Jennifer Martel at their Waltham apartment.
 
The 35-year-old Remy has pleaded not guilty and is being held without bail. He's the son of Red Sox broadcaster Jerry Remy.
 
Remy's lawyer said a "statement of the case" prosecutors wanted to release is "inflammatory" and serves no purpose except to give a one-sided view of the evidence. Prosecutors and Remy's attorneys ultimately decided to cancel the hearing after prosecutors decided they did not need to file the statement of case at this time.
 
Middlesex prosecutors routinely file a statement of the case after a defendant is arraigned in Superior Court.

Remy's next court date is scheduled for Oct. 28.
