Grand jury declines to indict Cohasset man

QUINCY (AP) - A grand jury has declined to indict a Cohasset man in connection with his brother-in-law's death after the two scuffled at a party.

Norfolk District Attorney Michael Morrissey says John McDonough no longer faces criminal charges.

Police arrested the 45-year-old in May on manslaughter and assault charges following the death of his wife's brother, David Hoelzer.

Hoelzer died on his 45th birthday after drinking and struggling with McDonough while he was the guest of honor at a party at McDonough's home.

Morrissey said Monday that grand jurors had more information available than authorities had at first, and he accepts their decision.

McDonough's lawyer Robert Harnais called Hoelzer's death a "tragic family accident," and says McDonough and his relatives just want to move forward and grieve.
