FALL RIVER, Mass. (MyFoxBoston.com) -- A grand jury indicted an Easton man on his eighth charge of operating under the influence Monday, according to the Bristol County District Attorney's office.
The man, David Frates, 46, was arrested at around 1:30 a.m. Wednesday in Rehoboth and charged with operating under the influence and driving without a license. His license had been revoked during a previous OUI offense, the District Attorney's office said.
The Bristol County Grand Jury indictment means that Frates will now be held without bail until his trial.
Rehoboth police said they also found Frates with an open container of alcohol in his car. Frates was arrested on Route 44 in Rehoboth, where police say he tried to convince an officer that he was texting someone, according to the Sun Chronicle. When he showed the officer his phone, he was also holding an alcoholic mixed drink and almost spilled it.
