Driver not guilty in 2010 fatal Cape Cod crash

BARNSTABLE (AP) - A Cape Cod judge has found a motorist not guilty ina teenager's death after a fatal crash on New Year's Day in 2010.

The Cape Cod Timesreports Andrea Mastandrea was acquitted Wednesday of leaving the scene of anaccident causing death, and negligent motor vehicle homicide.

The 31-year-old admitted her car hit and killed 17-year-old Andrew Dexter IIin Bourne, but said she didn't know it at the time and left the scene afterhearing a "thud."

Dexter had been walking home from a party after drinking.

The Barnstable Superior Court judge said a recent Supreme Judicial Courtruling guided his verdict.

It says a motorist has to know he or she hit someone to be guilty of leavingan accident scene after causing death.

Dexter's family said there's been no justice.
