Driver in Chatham deadly crash held without bail

CHATHAM, Mass. (MyFoxBoston.com/AP) – A driver accused of striking and killing a man at a Cape Cod bus stop before crashing into a car carrying a family of four leaving an ice cream shop has pleaded not guilty to driving charges.

Benjamin Shealey, 32, of Providence, R.I. was arraigned on several charges Monday, including failing to stop for police, and was held without bail until his dangerousness hearing on Wednesday.

Albert Dellamalva, 62, was hit in front of the " Kream N' Kone ice cream shop in Chatham Saturday night. The driver who allegedly struck him was being pursued by police after failing to stop for authorities in neighboring Harwich.

After hitting Dellamalva, the Range Rover slammed into several cars, injuring a vehicle with two adults and two children inside.

Police said they were trying to stop him after complaints about a reckless driver.

Shealey was represented by his uncle who is an attorney. He told the Cape Cod Times prosecutors told him his client also faces a motor vehicle homicide charge. His lawyer says Shealey doesn't remember what happened.

The conditions of the four injured is unknown.

The incident is under investigation.
