Couple accused in Orange home invasion, murder due in Mass. court

ORANGE, Mass. — The couple accused of killing an elderly man in Orange will appear in a Massachusetts courtroom Friday.

Police found Brittany Smith and Joshua Hart in a rental truck outside a Walmart in Virginia last weekend. The couple was brought back to Mass. Wednesday night.

Both are from Athol, Mass. and are accused of breaking into a home in Orange last week and killing 95-year-old Thomas Hardy. Hardy's 77-year-old wife was also attacked, but survived.

The Franklin County District Attorney's Office says both suspects will be arraigned in Orange District court at 11:30 a.m. after their extradition from Virginia.

Prosecutors say Hart, 23, and Smith, 27, broke into Hardy's East River Street home last week, killing the 95-year-old and injuring his, Joanna Fisher.

Police say Smith and Hart stole the elderly couple's station wagon, which led investigators to Virginia. There, a local sheriff's office said deputies arrested Hart and Smith early Saturday.

The two suspects face charges of murder, attempted murder, home invasion and more.
