• Cape Cod murder trial gets under way

BARNSTABLE (AP) - The trial of a Newton man who is charged with fatally shooting a man at his Cape Cod summer home in a family dispute over money has started.

Jury selection in the trial of 48-year-old Robert Upton began Monday in Barnstable Superior Court.

Upton is charged with killing Aris Manoloules of Framingham in his Hyannis home in September 2009.

Prosecutors say Upton and Manoloules' teenage nephew went to the home and killed him. Upton was allegedly hired to do the killing.

Treefon Manoloules, the victim's brother, was acquitted of plotting the killing in 2011.

Authorities have said there was a family dispute over a $3 million inheritance.

Upton has pleaded not guilty. The trial is scheduled to continue Tuesday.

    The nephew is awaiting trial.
