Defense in Hernandez double murder trial claims new evidence

BOSTON — Aaron Hernandez's double murder trial was delayed Monday pending hearings regarding evidence and testimony. The jury was excused for the day just past 10 a.m.

The day began with the judge announcing that the defense had filed three different motions to dismiss. Each motion was about sixty pages long.

According to FOX25's Ted Daniel, the motions allege abuse of subpoena power and destruction of evidence. The motions also questioned what one witness, a street sweeper, would be allowed to testify about before the jury.

Hernandez is accused of shooting two men, Daniel de Abreu and Safiro Furtado, after de Abreu accidentally bumped into Hernandez, spilling his drink. Prosecutors say Hernandez opened fire on the men at a stoplight, while the defense claims that Hernandez's former right-hand man, Alexander Bradley, is the real killer.

At one point, the street sweeper told authorities about a third vehicle, a white SUV, at or near the crime scene that included a woman with braids hanging out of a sunroof and possibly holding a camera. The defense wants that evidence introduced.

The street sweeper told a defense investigator that he was told by police after the shooting to empty his vehicle so officers could see if he swept away any evidence. The prosecution claims the sweeper emptied his vehicle on his own.

The jury was kept out of all discussions involving the motions introduced Monday. The street sweeper took the stand Monday afternoon without any jurors present.

While on the stand, the street sweeper said police "disrespected him" and tried to "prep" him before court.
